Terms and Conditions
1. Scope
1.1. These Terms and Conditions (T&Cs) apply to all purchase contracts for the delivery of products concluded between Eazy Nature, Kastanienallee 2, 14050 Berlin (hereinafter referred to as “we” or “Eazy Nature”) and you as the customer via our online shop at www.eazynature.com. The version of the T&Cs valid at the time of your order shall apply.
1.2. Deviating or supplementary terms and conditions provided by you as the customer shall only apply if we have expressly agreed to them.
1.3. Our products and services are intended exclusively for consumers as defined in § 13 of the German Civil Code (BGB). A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.
1.4. Use of our online shop and the purchase of goods is permitted only for persons of legal age.
1.5. The contract language is German. Translations are for informational purposes only; the German version is legally binding.
2. Conclusion of Contract
2.1. The presentation of products in our online shop does not constitute a legally binding offer, but an invitation for you to submit a binding offer.
2.2. You submit a binding offer to enter into a purchase contract by placing the desired products in the virtual shopping cart, entering the required information, and clicking the “Buy” button. You can review and modify your entries at any time before submitting the order.
2.3. After receiving your order, we will send you an order confirmation by email. This confirmation does not constitute acceptance of your offer, but merely informs you that we have received your order.
2.4. The purchase contract is only concluded when we explicitly accept your order by sending a shipping confirmation via email. Items not listed in the shipping confirmation are not part of the contract.
2.5. We reserve the right to reject orders, particularly if the ordered quantities exceed normal household amounts.
2.6. If you choose a payment method involving immediate payment (e.g., credit card or PayPal), we accept your offer implicitly by enabling the payment process. If delivery becomes impossible without fault on our part (e.g., due to non-delivery by our suppliers), we reserve the right to withdraw from the contract. In such cases, we will inform you immediately and refund any payments already made.
3. Right of Withdrawal
3.1. As a consumer, you have a statutory right of withdrawal. Details, including the withdrawal policy, can be found hier.
4. Prices, Payment Terms
4.1. Prices: The prices shown at the time of your order apply. All prices include statutory VAT and exclude shipping costs.
4.2. Payment Terms:
Available payment methods (e.g., credit card, PayPal, Apple Pay) are displayed during the checkout process.
The purchase price is due immediately and will be charged depending on the selected payment method.
4.2.1. Credit Card
When selecting credit card payment, the amount is initially pre-authorized upon placing the order. Your card will be charged shortly after completing the order.
4.2.2. PayPal
If you select PayPal, you will be redirected to the PayPal site to log in and confirm the payment. The purchase price plus shipping is due immediately. Payment is made via the payment method stored in your PayPal account (credit card, bank transfer, PayPal balance, or Giropay). If you do not yet have a PayPal account, you may create one during the process.
4.2.3. Apple Pay
When selecting Apple Pay, you authorize payment using your login credentials. The payment amount becomes due immediately after conclusion of the contract. The charge is made via the payment method saved in your Apple Pay account. After submitting your order in our shop, you will be redirected to Apple to authorize the payment. 5. Delivery, Shipping Costs, Product Availability
5.1. Delivery & Shipping Costs:
We deliver within Germany and to EU countries and Switzerland to the shipping address provided by you.
Shipping is handled exclusively by Deutsche Post and DHL.
Shipping costs will be shown during the checkout process.
Delivery time within Germany is typically 1–3 business days. Delivery times to other European countries can be found [here].
These delivery times apply only if the goods are in stock. Public holidays in Germany or other European countries may cause delays.
5.2. Force Majeure: Events of force majeure (e.g., natural disasters, strikes, government orders) may delay delivery. We will inform you promptly of such delays. If the delay lasts longer than four weeks, both parties may withdraw from the contract. Payments already made will be refunded.
5.3. Product Availability: We strive to ensure sufficient availability of products shown in our shop. However, availability cannot be guaranteed at all times. If a product is temporarily unavailable, this will be stated in the order confirmation. If the delay exceeds four weeks, you may withdraw from the contract. We reserve the same right and will refund any payments already made. If the product is permanently unavailable, we will not issue an acceptance of your order. In this case, no purchase contract will be formed.
6. Retention of Title
6.1. Goods remain our property until full payment has been received.
7. Warranty, Transport Damage
7.1. The statutory warranty regulations apply, especially §§ 434 ff. BGB.
7.2. Please report any obvious transport damage to the carrier immediately and inform us as well. Failure to do so does not affect your statutory warranty rights but helps us assert our own claims against the carrier.
8. Liability
8.1. Our liability is limited to damages resulting from the breach of essential contractual obligations and to foreseeable, contract-typical damages, unless caused by intent or gross negligence. We are fully liable for damages resulting in injury to life, body, or health.
8.2. Regardless of fault, we are liable in cases of fraudulent concealment of defects, the assumption of a guarantee, or under the provisions of the Product Liability Act.
8.3. The above limitations of liability also apply to our legal representatives, employees, and agents.
8.4. We accept no liability for damages caused by improper use that deviates from the packaging or instructions.
9. Data Protection
9.1. The data required for processing your order will be stored and may be shared with service partners, such as delivery companies, as part of order fulfillment. All data will be treated confidentially in accordance with legal requirements. Further information is provided in our hier.
10. Dispute Resolution
10.1. Under applicable law, we are obligated to inform you of the existence of the European Online Dispute Resolution platform, which can be used to resolve disputes without going to court. This platform is operated by the European Commission and is available at: http://ec.europa.eu/odr
10.2. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Final Provisions
11.1. If any provision of these T&Cs is or becomes invalid, the validity of the remaining provisions shall not be affected.
11.2. German law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of their country of residence.
11.3. If the customer is a merchant, legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes is the registered office of Eazy Nature in Berlin, Germany.
